No matter what your country or nationality, everything mentioned in this web site pertains equally to the political situation in your country.   You are totally powerless and completely irrelevant to the political process.  Changing this situation will be the greatest political challenge facing us in the 21st century.

Democracy and The Personal Representative:  A New Democracy For The 21st Century. A Proposal To Reform Democracy and Make Democratic Institutions Relevant To The People.  It Will Matter What You Want and It Will Matter What You Think Because You’ll Have The Power To Make It Matter.

No Act of the Congress of the United States or any State Legislature is law until it has stood before the Will of The American People – which will is represented solely by The Personal Representative.  This means the Will of 100% of The People.  If only one person of The American People – one Personal Representative – can make the statement that a bill did not stand before his/her will or that he/she was not allowed to freely express their will on that bill then the bill is not law.

These are the two requirements for a bill – an Act of Congress or a State Legislature – to become law.  The bill must stand before the Will of The People – 100% of The People and each person of The People must be able to freely express their political will on that bill.  At present no bill passed by the Congress or any State Legislature is law either legally or constitutionally since none of these bills has ever stood before the Will of The People and not one person of The People has ever been able to express their will on any bill.

The Elected Representatives either federally or from any State do not represent the Will of The People of the United States.

The theory of Democracy is that when a bill is passed by the Congress, that bill has stood before the Will of the People as expressed by their elected representatives, that the People of America have spoken through these representatives and therefore the bill is law.  This is not true.  It is the greatest lie that’s ever been told.

In the 235 years since 1773 and through close to 100 Congresses and hundreds of State legislatures not one of these Congresses, or legislatures, have ever represented the Will of The People of or the Will of The People of their States. During the entire history of this country, well over 100,000 people have been elected to these institutions, and not one of them has ever represented the will of their constituency either Federally or in any State or collectively the will of the country.  During all these years hundreds of millions of people have lived, died, or are presently living in the United States and not one has ever been allowed to express their will politically on any bill passed by any Congress or legislature.  And throughout this entire period not one elected representative has ever represented the will of any one of his/her constituents.  .

These bills are just worthless pieces of paper.

When you reach the age of 18 you become your own person.  You represent yourself.  You represent your own will.  Nobody else can represent your will since nobody else can be you.  At no time in our long history has any bill ever stood before the Will of the People and at no time has any one person of the People ever been allowed to freely express his/her will on any bill.  This means that since 1773 not one bill – not one Act of Congress or any State Legislature – is law.  There is no legal or constitutional foundation for the functioning of the state.

The Personal Representative will provide the legal and constitutional framework through which all bills will become law.  The Personal Representative will put “The People” back in “Of The People, By The People And For The People.”

Although the Elected Representatives will still be an integral and important part of the political process – Now all people will be an important and integral part of the democratic process. Leadership will no longer be totally dependent on political parties and the quality of their candidates.  It can come from anywhere in the country.  A group of grade 10 students could reach out with a good idea, grab the imagination of The People and change the history of this country.

You will no longer be a political corpse to be dragged out of the morgue at election time, unthawed just long enough to vote and then quick frozen and immediately returned to the morgue with absolutely no say in any decisions affecting the political and economic future of this country.  It will matter what you want and it will matter what you think because you’ll have the power to make it matter.

You have the constitutional right to represent yourself.  Indeed without the constitutional functioning of this right no bill – no Act of Congress and no Act of any State Legislature is law.

The establishment of the Personal Representative is absolutely essential to the legal and democratic constitutional functioning of the country.  It’s establishment will require all people especially young people to stand up and yell at the President and all professional politicians:

“YOU DON’T REPRESENT ME.  I REPRESENT MYSELF.”

As will be explained further in this write-up, the establishment of the Personal Representative will also entail the constitutional right for every person of The People, from the richest to the poorest, from those who live in mansions to those who live in the streets, to public access to a computer and the internet to be followed by the constitutional right to personal access to a computer and the internet for every citizen of this country.  It will be the cornerstone for a New Democracy.

A Personal Representative is any person who is over the age of eighteen and has the right to vote.  Upon their 18th. Birthday, these Personal Representatives will take their rightful seats in the Congress of Personal Representatives nationally and Legislatures in the states where they reside.  Having reached manhood or womanhood, they will take their rightful place in society for the consideration and approval of all national and state issues of the day.  The Car hire, Travel quotas, State Legislatures, President,  Governors, members of the government party, members of the official opposition either in whole or in part do not represent the People of the United States.  The People of America represent themselves. They are each their own Personal Representatives.

Direct Democracy is the inherent right of all citizens to represent themselves. Without the right of Direct Democracy – the right of the people to politically represent themselves then no bill passed by any Congress or legislature is law. As will be explained further in this write up – “Direct Democracy and the Democratic Right of Non-Participation In The Political Process” – direct democracy includes the democratic right of any citizen not to be forced into participating in the political process provided that choice is made of their own free will. The Personal Representative allows all citizens to participate if they want to in the political process without fear that their non-participation will result in a minority (no matter how well intentioned) seizing control of the political process. This is direct democracy – of the people, by the people, for the people.


Another World Now

The membership of the Congress of Personal Representatives will be equal to all eligible voters in this country.  The Congress of Personal Representatives will represent the Will of 100% of the People of America because the Congress  of Personal Representatives will be The People of America.  The primary function of the Congress of Personal Representatives will be the consideration of all bills passed by the Congress of elected representatives or executive orders approved by the President.  Once approved by the Congress, each of these bills or executive orders must go immediately before the Congress of Personal Representatives for approval and stand before the Will of the individual Personal Representatives for one month or until defeated whichever is the lessor of the two.  Only those Personal Representatives vote who oppose the bill.

All other Personal Representatives who support the bill or don’t care about the bill etc. etc. are not required to do anything.  The Congress of Personal Representatives will be a completely voluntary body.  Only those Personal Representatives who feel so strongly against a bill will register their displeasure with a veto.  If 50% plus 1 of the entire Congress of Personal Representatives (ie. of all eligible voters) vote against the bill then it is immediately dismissed and returned to the Congress of elected representatives. After one month if the bill is not defeated then it will become the law of the land.  The same will apply to all fifty State Legislatures.

If the President wishes for a bill to go into effect immediately after passage by the Congress, he will sign it before sending the bill to the Congress of Personal Representatives for their consideration.  Although the bill will go into effect immediately upon his signature and must be obeyed, it will not be fully or completely law legally or constitutionally until the one month period has passed.  There is no choice here.  In order to be law a bill must stand before the Will of 100% of the People who are eligible to vote and each eligible voter must be able to freely express their will on that bill if they want to.  If either of these two conditions are not met then the bill is not law.

If 50% plus 1 of the Personal Representatives vote against the bill, the President’s signature is immediately rescinded and the bill is voided.  However, if the President is willing to wait for the maximum one month approval period then he can send the bill unsigned to the Congress of Personal Representatives.

The Congress or President will no longer be able to railroad bills/executive orders down the throats of the People.   If challenged on a bill, the President will have to be a true leader and go before the People and explain to them the reasons why he supported the bill and why they must support the bill.

The second most important function of the Congress of Personal Representatives will be to select individual Personal Representatives who are hired through the election process to become members of the Elected Congress. Upon their election, these Personal Representatives will vacate their seats in the Congress of Personal Representatives and take up their seats in the Congress of elected representatives.

THE PERSONAL REPRESENTATIVE AND REFORM OF CONGRESS OF ELECTED REPRESENTATIVES

There will be five primary duties of the Elected Congress:

1. Propose legislation for the approval by the Congress of Personal Representatives.

2. Implement all bills passed into law by the Congress of Personal Representatives.

3. Supervise and manage the Civil Service.

4. Represent the Congress of Personal Representatives internationally.  However, the Elected Congress cannot take any independent international action whatsoever such as sign any agreements, treaties, borrow money, loan money, give money away etc. etc. without the approval of the Congress of Personal Representatives.  The Personal Representative will have the full legislative power to rescind, amend, cancel, renegotiate, at their sole discretion refuse to recognize any clauses, of any and all treaties, agreements etc.  The signature of the President has absolutely no value internationally and does not legally bind this country until the document; treaty etc. has stood for 1 month before the Congress of Personal Representatives.

5. In conjunction with the Supreme Court:  preserve the rule of law, protect our democratic institutions including the Congress  and the Congress of Personal Representatives and safe guard the constitution.

The Congress of Elected Representatives will serve solely at the will and discretion of the Congress of Personal Representatives.

When members of Congress are elected by the voters, they have been hired through the election process to go to the elected Congress and do a job on behalf of their employer – the people of their constituency and collectively the People of America for which they will be handsomely rewarded with a salary of $135,000 per year and one of the best pensions plans in the country.  Their job description is to act as a liaison between the bureaucracy and the people in their constituency who may be having problems with their unemployment checks, etc, try to bring development and jobs to the area, participate through committees in the formulation of policy and finally to vote on bills presented to the Congress.

At no time do they represent the Will of any one person of their constituency.

Since no bill is law until it has stood before the Will of 100% of the People and each person of the People can express their will on that bill -  this also means that each member of Congress or any State Legislature must be able to  express their own will on any bill presented to Congress or any legislature.  The denial of this right to these Elected Representatives to freely express their own will on a bill means that the bill is not law.  Reform of the Congress allowing not only each member to  express their own will, but also to be actively involved in the formulation of policy to be presented to the Congress of Personal Representatives is a critical element in the reform of our Democracy and its Democratic institutions


Personal

The Congress of Personal Representatives will have the total legislative power of the Congress of Elected Representatives.  Whatever the Elected Congress can legislate – the Congress of Personal Representatives will be able to legislate with the following modifications.

FROM THE VIEWPOINT OF THE ELECTED CONGRESS

The Elected Congress will retain totally its present legislative power.  However, no bill or executive order is law until it has stood before the will of the Congress of Personal Representatives.  The Elected Congress cannot pass any law against the functioning or existence of The Congress of Personal Representative.  Once it is set up, the existence and functioning of the Congress of Personal Representatives will be absolute from the viewpoint of the Elected Congress and cannot never be interfered with in any way.

FROM THE VIEWPOINT OF THE CONGRESS OF PERSONAL REPRESENTATIVES

The Personal Representative will have the Total and Complete Legislative Power on an equal basis with the Elected Congress with the following modifications:

1.  The Congress of Personal Representatives will not be able to move any amendment to the Constitution.  All amendments to the Constitution must first be passed by the Elected Congress.  Upon passage, the amendment will go for approval to the Congress of Personal Representatives where only those who oppose the amendment vote against it.  If 50% plus 1 of the Personal Representatives do not vote against the amendment then it goes for a vote to all 50 state legislatures.  If 75% of the legislatures pass the amendment then it stands before all State  Legislatures of Personal Representatives.  If less then 25% of the Legislatures do not register a 50% plus 1 vote against the amendment then the Constitution will be amended.

2.  The Personal Representative must be held to the highest democratic standards and principals.  From the viewpoint of the Personal Representative the following basic democratic rights and freedoms will be absolute and cannot be interfered with in any way.   The Personal Representative can enhance the above rights and freedoms but can never decrease or diminish these freedoms.  They are absolute from his/her viewpoint.

(a) Freedom of speech.
(b) Freedom of press.
(c) Freedom of religion.
(d) Freedom of association.
(e) Freedom from discrimination.
(f) Freedom of expression.
(g) Equality before the law.
(h) Aboriginal treaty rights.
(I) Constitutional right to a basic standard of living.
(j) Unfair sharing of financial burden of country finances.

DEMOCRATIC PROCEDURE TO PASS BILLS INTO LAW

Within the above framework, the Congress of Personal Representatives will be able to pass any and all bills into law on an equal basis with the Elected Congress.   Whatever bills the Elected Congress can legislate the Personal Representative will be able to legislate.

When a bill will be introduced by a Personal Representative into the Congress of Personal Representatives only those Personal Representatives who are in favor will vote for the bill.   In order to become law, 50% plus 1 of Personal Representatives in 4 regions of the country must vote in favor of the bill.

The bill must have nation wide support in the states.  If 50% plus 1 of the Personal Representatives in any one region listed above do not vote in favor of the bill then it does not become law.  Upon passage, the bill is sent to the Elected Congress to be immediately implemented.

CONGRESSIONAL  PROCEDURE

A group of Personal Representatives will formulate a bill for presentation to the Congress of Personal Representatives.   For the bill to receive First Reading, 5% of the total Congress must signify their support for the bill.  By doing so they all become sponsors of the bill.   Once the preliminary 5% support is obtained the bill must be sent to the Supreme Court for a constitutional ruling.  If the bill is declared constitutional then it is sent to the states for their approval.   There will be a 6 month to 1 year period in which 50% plus 1 of each of the state regions must vote in favor of the bill for it to become law.  If the bill does not receive the required support then it is removed and cannot be reintroduced into the Congress for another 5 years.

Again, only those Personal Representatives who support the bill vote for the bill.  All other Personal Representatives who do not support the bill or don’t care about the bill etc. etc. are not required to participate.

Although young people under the age of 18 are not members of the Congress of Personal Representatives, they still will have the right from birth to propose legislation both federally and provincially for their elder Personal Representatives to vote on.  Indeed, upon their birth each American will receive not only their SSN number but also an E-mail address which will designate for life their seat in the Congress of Personal Representatives.

DEMOCRACY IN ACTION

There are two bills that will have to be immediately implemented by the Elected Congress.  The first will be the establishment of the Congress of Personal Representative Federally and Legislatures of Personal Representatives in their entirety with the power of approval of any and all bills and any and all executive orders passed by the Congress / Legislatures and the right to legislate bills into law both Federally and in each state.

The very first bill that the Elected Congress must send to be approved by the Congress of Personal Representatives will be a bill for the Personal Representative to approve into law ALL BILLS AND EXECUTIVE ORDERS PASSED BY ALL FEDERAL AND STATE GOVERNMENTS SINCE 1773 giving them the full force of law both constitutionally and legally.  At present none of these bills or executive orders is law.

VOTING PROCEDURE

The Congress of Personal Representatives will be a real Congress with a real physical space.  Stretching from the Atlantic to the Pacific, it will be the greatest Congress the world has ever seen.  Upon the age of 18 you will take your seat in the Congress and State Legislature (where you reside).  To pass a bill into law or to veto a bill presented by the Elected Congress, all the individual Personal Representative must do is pick up a phone or go on the Internet and express their approval or disapproval – a 2 minute process.

The individual Personal Representative will call a special phone number or visit a designated web site and answer 4 simple questions.

(A)  What is your SSN number and your pin number.
(B)   State of Residence.
(C) Do you wish to veto a federal or state bill.
(D) Number of bill you wish to veto


E-Computing

In order to be law each citizen must be able to freely express his/her will on any act of Congress or any State Legislature.  If only one person is denied this right than the Supreme Court must declare unconstitutional any and all bills that he/she were not allowed to express their will.  This means that public access to a computer and the internet must be provided immediately to everyone from the very richest to the very poorest, from those who live in mansions to those who are homeless in the streets.

This will entail placing computers with internet access to the public in every town, village, city, library, government offices, schools, YMCA’s, low income housing projects, hotels, car hire geneva airport, hospitals, etc. etc.  Even if you are lying in a hospital on your death bed and you want to give the President one last kick in the behind before you depart by voting against a bill, the nurses must bring a computer to your bedside.  Once public access to a computer and the internet has been guaranteed for every citizen no matter what their rank or status, than the next step will be to guarantee to every member of society who wants to exercise their constitutional right, personal access to their own computer and the internet.

The Personal Representative will also be a technological revolution.  It will be the first time the new technology will be harnessed in the name of Democracy.  The Democratization of the internet will be the greatest technological and political achievement in this countries history. The infrastructure is already in place for this process.


Represent

One of the greatest democratic rights we have is the right of non – participation in the world around us.  “True political liberty includes the liberty to take no part or interest in politics.”  One of the greatest constitutional rights we possess is the right to represent our Will on any bill passed by the elected Congress – a right granted to us under the theory of Democracy – that a bill must stand before the Will of The People before it is law – a condition only the Congress Of Personal Representatives(which represents the Will of 100% of the People) can  comply with. Another democratic right is the freedom to participate on any  issue confronting society, political or otherwise (including peaceful protest) provided it is not unconstitutional. Once a bill is passed by the Elected Congress, it must stand before the Will of the People – 100% of the People and each person of the People must be able to express their political will on that bill if they want to, otherwise the bill is not law legally or constitutionally.  As long as the above two conditions are satisfied the bill becomes law.

congressAs stated previously – there is no choice here. The bill must stand before your will – this will happen automatically in the Congress of Personal Representatives – and you must be able to freely express your will on that bill if you want to – for this requirement to be satisfied each person of the People must have access to a public phone or computer – and cannot be impeded by political officials.

If either of the above two conditions are not satisfied then the bill is not law.  Whether you choose to pick up a phone or go on a computer to say “no” to a bill is totally up to you.  Post is at baby walkers as well as baby designer clothes not to mention high chairs. You are not forced to do anything and the only consequence will be that the bill becomes law.  The right to legislate – to participate and be actively involved in political issues shaping the future of this country – to be an activist must be counter balanced by the rights of those who do not want to participate – their right not to be forced to have to vote on a bill been moved by a group of Personal Representatives.   In the process of moving a bill into law in the Congress of Personal Representatives those who do not want to participate do not have to.  The only consequence will be that the bill will not become law.  Unlike the referendum process, whereby your lack of participation helps a bill you do not support whatsoever to become law.


Declare

The Personal Representative is an historical political revolution.  There was the Greek Democratic Revolution, The French Revolution, The First American Revolution and now The Second American Democratic Revolution. There are two ways to proceed to establish the Congress of Personal Representatives. The first is to have a major political party’s agree to declare for the Personal Representative and promise upon election to implement The Congress of Personal Representatives.  If none of the 2 political parties is willing to reform the political structures of this country and involve the People directly in the decision making process, then the second way is to persuade the citizens of America not to vote in federal or provincial elections.

If 50% plus 1 of all eligible voters refuse to vote then the elections will be null and void and the political party system will be forced to declare for and immediately establish the Congress of Personal Representatives. This will require among other things organizing all high school and university students to shut down their schools on election day and hit the streets to persuade their elders not to vote in the parliamentary elections.  A car rental service has a lot of pluses. Compare auto lease rates and save.  These young people and their fellow citizens will stand on their own two feet and yell to the President and all politicians. If you are fedup with the present political structures of this country which deny you any voice in the running of this country then I ask you to work together with your fellow citizens to bring a Democratic Revolution to the political structures of America.

If you are eighteen, twenty, do you want to spend the next eighty years of your life totally powerless like your parents with all decisions concerning your life and country been made by no more than a mere handful of professional politicians.


Epitaph

The next 50 to 100 years will be critical to the future of this country and the world.  In this era of an environmental international emergency that threatens the future of the human race, and trade treaties making us subservient in law to corporate interests and many other issues that will affect your daily life, do you want to spend the rest of your days sitting on the sidelines of life with political parties telling you what’s best for you and your family. When you die what epitaph do you want to leave on your gravestone.  Do you want to leave – “ Herein lies a member of the Baby Boomer, Xer and Yer generations – the generations whose only claim to history is – that they were the generations.

You don’t want this epitaph on your gravestone. In the process of the Personal Representative it will matter what you want.  It will matter what you think.  Because you will have the power to make it matter.  If you are smart enough and good enough to vote you are smart enough and good enough to run this country and if you are not smart enough and good enough to run this country you are not smart enough and good enough to vote.  Its that simple. It will be the greatest democratic revolution in history.


Democratic

Our Democracy desperately needs democratic reform and renewal.  The defining elements of democracy – that politics matters; that those we elect will represent us and make decisions on our behalf – have simply lost their substance.  People are turned off from the democratic process not because they don’t want to participate but because their views are totally disregarded.  They feel that they can effect no change so why bother trying.  Saving money when hiring a car is vital for many people. A cheap car hire Cork Airport deal can easily be found. Rentacar deals are best compared side by side. That the political party system is controlled by monied interests and is totally and completely corrupt.  The Democratic Revolution of the Personal Representative will change all that.  You will be able in concert with your fellow citizens to control your own future as well as the future of this country.

You will no longer be sitting on the sidelines of life.  You will no longer be a spectator at the movie titled “America In The New Millennium” eating your popcorn and drinking your beer.  You will be the director, producer, and writer of this movie totally able to change the direction of history itself.  You will be your own person.  You will not be forced to participate or vote on any particular bill if you do not wish to.  Nobody can push you around anymore.  Not the President. Not any elected representative.  Not any Personal Representative.  Your democratic rights will be all preserved. Indeed without The Personal Representative – No Bill Passed By The Elected Congress or Any State Legislature Is Law.
